Article 1 – PRICES
1.1 – FIGURES PHOTOGRAPHY reserves the right to modify its prices at any time, but subscriptions will be invoiced on the basis of the rates in effect at the time orders are registered.
1.2 – In the event of an order to a country other than metropolitan France, customs duties or other local taxes or import duties or state taxes may be payable on the magazine(s) exported. These duties and taxes are not the responsibility of FIGURES PHOTOGRAPHY. They shall be borne by the customer as the importer of the magazines and shall be the customer’s sole responsibility both in terms of declaration and payment to the authorities and/or competent bodies in the customer’s country.

ARTICLE 2 – VALIDATION
When you click on the ‘Validate’ button after the order process, you declare that you accept the order and all of these General Terms and Conditions of Sale fully and without reservation.
The data recorded by FIGURES PHOTOGRAPHY constitutes proof of all transactions between FIGURES PHOTOGRAPHY and its customers.

ARTICLE 4 – AVAILABILITY
With regard to the sale of back issues, our offers are subject to availability.
Products remain the property of FIGURES PHOTOGRAPHY until full payment has been received.
If a product is unavailable after you have placed your order, we will inform you by email as soon as possible. You may then request the cancellation or exchange of your order.

Article 6 – SECURITY GUARANTEES FOR PAYMENTS ON THE INTERNET
Payments will be made by credit card; they will be made via the Stripe secure system which uses the SSL (Secure Socket Layer) protocol so that the information transmitted is encrypted by software and no third party can gain knowledge of it during transport on the network.

ARTICLE 7 – CANCELLATION AND REFUND
8.1 – Your order can be cancelled and refunded as long as the package hasn’t been prepared yet (in case of shipping), or if the service hasn’t been provided yet (in case of online service).
8.2 – Refunds will be made within 30 days of receipt of your request. Refunds will be made by crediting the bank account of the original order.
8.3 – Cash on delivery will not be accepted for any reason whatsoever.

ARTICLE 10 – LIABILITY
The magazine offered complies with current French legislation. FIGURES PHOTOGRAPHY may not be held liable in the event of failure to comply with the legislation of the country to which the items are delivered (prohibition of a title, etc.). It is your responsibility to check with the local authorities about the possibility of importing or using the products you are considering ordering. The photographs and texts reproduced and illustrating the products presented are not contractual. Consequently, FIGURES PHOTOGRAPHY may not be held liable in the event of an error in one of these photographs or texts. FIGURES PHOTOGRAPHY shall not be held liable for breach of contract in the event of stock shortage or unavailability of the product, force majeure, disruption or total or partial strike, in particular of postal services and means of transport and/or communications, flood or fire.
FIGURES PHOTOGRAPHY shall not be held liable for any indirect damages, operating losses, loss of profit, loss of opportunity, damages or expenses.

ARTICLE 11 – APPLICABLE LAW – DISPUTES
This contract is governed by French law.
The language of this contract is French.
In the event of a dispute, the French courts will have sole jurisdiction.

ARTICLE 12 – Intellectual property
All trademarks, photographs, texts, comments, illustrations, images (animated or not), video sequences, sounds, as well as all computer applications that may be used to operate this site and, more generally, all elements reproduced or used on the site are protected by current intellectual property laws.
They are the full and entire property of the publisher or artist. Any reproduction, representation, use or adaptation, in any form whatsoever, of all or part of these elements, including computer applications, without the prior written consent of the publisher, is strictly prohibited. The fact that the publisher or artist does not initiate proceedings as soon as it becomes aware of such unauthorised use does not constitute acceptance of the said use and waiver of legal action.
